1. Game Timing/Description: The Gold Standard Instant Win Game ("Game") begins at 12:01 AM ET on 3/10/08 & ends at 11:59:59 PM ET on 5/31/08 ("Promotion Period"). Sixty two (62) Instant Win moments will be randomly seeded by Sponsor (defined below). Winners will be notified instantly if they are a winner, but will not instantly receive a Prize. See Section 7 below for details regarding how a prize may be claimed.
2. How to Play the Game for a Chance to Win a Prize: Go to www.chavrie.com at any time during the Promotion Period, and click on the promotion icon. Complete the registration page including your name, address, email address, telephone, code from a participating Chavrie products, and password. A free code will be available on the website. Participating Chavrie products include: Chavrie® Original 5.3 oz. and 7.1 oz., and Chavrie® Basil & Roasted Garlic. The code is the 8-digit number printed on the insert in participating Chavrie products. Once completed, click "submit" and you will be taken to the Game play page. Follow the instructions, and you will be instantly told online if your Game play is a winning or non-winning Game play. If you receive a winning game play, you will be told online how to claim your prize. The number of Instant Win winning moments will be seeded randomly by Sponsor throughout the Promotion Period. Game play must be completed during the Promotion Period in order to be valid. Proof of play and/or winning will not be deemed valid unless verified by Sponsor. Limit one (1) Instant Win Game play per person/email address per day during the Promotion Period. Limit one (1) email address per person. For the purposes of this promotion, a "day" is defined as the 24-hour period beginning at 12:01 AM ET and ending at 11:59:59 PM ET. Use of any automated entry software is prohibited. Online Game plays made with multiple e-mail addresses, under multiple identities or through the use of any agent or other device or artifice to play multiple times in one day will be deemed invalid. BC-USA, Inc., 400 S. Custer Avenue, New Holland, PA 17557 ("Sponsor") assumes no responsibility for incorrect or inaccurate entry information, human error or technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any computer equipment or software, or any combination thereof, or for lost, stolen, late, illegible, misdirected, entries or mail. If a dispute results as to the identity of an online participant, it will be determined that the online game play was submitted by the authorized account holder of the email address from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address. Unclaimed prizes will be awarded in a Second Chance drawing. Sponsor will collect information from the entrant solely for the purpose of notifying winners and awarding prizes. Sponsor will not share this information with any third parties, including any prize providers, except as necessary for the administration of the Game, and the awarding of prizes, and will not attempt to contact entrant, and will abide by the terms of Sponsor's privacy policy located at www.chavrie.com.
3. Eligibility: Open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older at time of entry. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and the respective household members, of Sponsor, Cooking.com, their parent companies, their respective affiliates, subsidiaries, divisions, agents, distributors, individuals engaged in the development, production or distribution of Game materials, advertising and promotion agencies, and Promoter, are not eligible to participate. Game is subject to all federal, state, and local laws. U.S. law governs this Promotion. Game void in PR & where prohibited, taxed or restricted by law. Sponsor reserves the right to disqualify participants who violate these Official Rules or interfere with this Game in any manner. If a participant is disqualified, Sponsor reserves the right to terminate that participant's eligibility to participate in the Game.
4. Prizes/Odds of Winning: Grand Prize (1): A Cooking.com Gift Certificate in the amount of $1,000. Approximate Retail Value ("ARV"): $1,000. Odds of winning: 1:500,000. First Prize (1): A Cooking.com Gift Certificate in the amount of $500. ARV: $500. Odds of winning: 1:500,000. Second Prizes (60): A Cooking.com Gift Certificate in the amount of $100. ARV: $100/each. Odds of winning: 1:8,333. Total ARV of prizes: $7,500.
Odds based upon an estimate of 500,000 total Game plays transacted online over the Promotion Period; actual odds of winning will depend upon the number of Game plays transacted. All unclaimed prizes will be awarded in a second chance drawing (see section 5 below).
5. Second Chance Drawing: A random drawing will be conducted at the end of the Promotion Period to award any unclaimed prizes. A participant is automatically entered in the Second Chance Drawing when they complete and submit the online registration form, and each time they play the instant win game during the Promotion Period. Only non-winning game plays will be entered. Prize winners (if any) will be selected in a random drawing on or about 6/15/08 by Strobe Promotions, Inc. 535 So. Broadway, Suite 203, Hicksville, NY 11801 ("Promoter"), an independent judging organization, from among all eligible entries received. Winners will be notified by email or U.S. mail. Decisions of the judges will be final and binding on all matters relating to this Game. Odds of winning are dependant upon the actual number of entries received and the number of unclaimed prizes.
6. Prize Restrictions: All prizes will be awarded within 4-6 weeks after the prize is awarded (subject to Sponsor's verification of eligibility). Prizes are non-transferable; no substitutions allowed except by Sponsor due to unavailability, in which case substitution will be of equal or greater value. All applicable taxes and any other costs not specifically stated herein are responsibility of the winner. Any and all guarantees and warranties of merchandise prizes are subject to the manufacturers' terms and conditions, and winners agree to look solely to such manufacturers for any such warranty or guarantee claim. 7. How To Claim a Prize: Instant winners will receive immediate notification online from Sponsor after they play the Game if they have won a prize. Winners should print out the winning Game play message to keep a record for their files. No other action is required. Prizes won will be sent to the email address indicated on the registration form. If the email address is deemed to be invalid or no longer current, then the applicable winner forfeits his prize.
8. Conditions of Participation: By entering, entrants agree to be bound by these Official Rules & the decisions of the judges, which are final. All materials submitted in connection with the Game become the property of the Sponsor and will not be returned. By entering, every winner consents to the use of his/her name, image, likeness, photograph, voice and biographical material for advertising, publicity and promotional purposes by Sponsor, or a party designated by the Sponsor, in any and all media now or hereafter known including but not limited to, any online announcements, or for sharing this information with the press for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law. Entrants release and hold harmless Sponsor, Cooking.com, their parent companies, their respective affiliates, agencies, Promoter, and their employees, officers, directors and shareholders ("Releasees") from any claims, actions, injury, loss or damage of any kind, including but not limited to, personal injury or death, resulting from participating in this Game or from the acceptance, possession, or use or misuse of any prize awarded or participation in any prize-related activity.
9. Number of prizes: No more than the listed number of prizes will be awarded. In the event of an error, including but not limited to, printing, production, seeding, technical, computer or human error, or for any other reason, the number of winning game plays distributed or received for any prize level exceeds the number of prizes listed for that level, Sponsor reserves the right to conduct a random drawing from among all non-suspect eligible prize claims received to award the listed number of prizes.
10. Internet: If for any reason this game is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this game, the Sponsor reserves the right at its sole discretion, to void any entries or game plays at issue, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the game in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Releasees assume no responsibility for incorrect or inaccurate transcription of entry information, or for any human or printing error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, delay in operation or transmission, line failures of any kind including computer equipment, software, inability to access any online service or web site, inability to submit the online registration form, or any other error or malfunction, or for destruction or unauthorized access to, or alteration of, entries, or for late, lost, stolen, illegible or misdirected entries. Game materials that have been tampered with or altered are void. Releasees are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor or any game play to be served or received on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this game or downloading any materials in this game. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify entrants who violate the rules or interfere with this Game in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant's eligibility to participate in the Game.
